June 2, 2003 RE: Elevator and lift inspections I am writing in response to your letter asking what installation and periodic inspections are required by the Uniform Fire Prevention and Building Code for newly constructed residential elevators. It is our opinion that such inspection requirements are specified in the reference standards where the installation is permitted under the Building Code of New York State (BCNYS). Section 3001.2 of the BCNYS states, "except as otherwise provided for in this code, the design, construction, installation, alteration, repair and maintenance of elevators and conveying systems and their components shall conform to ASME A17.1, ASME A18.1, ..." This issue is further clarified in the enclosed advisory letter Al03-042. Each of the reference standards has specific requirements for inspections. You also ask what inspections are required for new and existing non-residential elevators and lifts. All such conveyances would be required to conform with section 3001.2 of the BCNYS as well, consistent with the scope and purpose of this code. It should be noted that construction regulated by the Residential Code of New York State (RCNYS) is not required to comply with the reference standards provided in BCNYS section 3001.2. The RCNYS has no requirements for the installation and maintenance of elevators and lifts in buildings it regulates. This advisory opinion is rendered based upon the information provided.
